Oportunidades e desafios para a reposição florestal na Amazônia e no Cerrado

• Current federal and state regulations often require minimal restoration areas compared to the land deforested. According to MMA Normative Instruction 6/2006, only one-third of the deforested area in the Amazon and one-fifth in the Cerrado needs to be restored.
• Financial resources collected through forest replenishment fees are frequently mismanaged or not used for restoration. In Goiás, Maranhão, and Pará, these funds lack a mandatory link to restoration activities. In Minas Gerais, despite collecting over 30 million reais in 2022 and 12 million reais between January and July 2023, no expenditures for reforestation programs were identified in transparency portals.
• The 2022 legislation in Goiás (Law No. 21.231/2022) is described as a significant environmental setback. It exempts agricultural, livestock, and silviculture activities—the primary drivers of land conversion—from the obligation of forest compensation, making compensation the exception rather than the rule.
• There is strong resistance among Amazon and Cerrado state governments to shift toward a paradigm of 'ecological equivalence' or 'no net loss of habitat.' Amazonian states often argue that their strict land-use rules (requiring 80% Legal Reserve) make further compensation unnecessary, while states in the Matopiba region (Maranhão, Tocantins, Piauí, and Bahia) continue to view replenishment as a raw material supply mechanism.
• The report suggests that forest replenishment could be transformed into an effective tool for restoring priority conservation areas and improving landscape connectivity through innovative management, such as the use of blended finance (combining public, private, and philanthropic funds) and specialized third-party management of collected fees.
