The AfCFTA Digital Protocol A bird's eye view

The AfCFTA Digital Trade Protocol (AfCFTA DTP), adopted in February 2024, is a comprehensive framework designed to facilitate digital trade across Africa. It aims to create an enabling regulatory environment by addressing market access, data governance, and digital inclusion, while bridging infrastructure and regulatory gaps to unlock the continent's digital economy potential.

• The AfCFTA Digital Trade Protocol (AfCFTA DTP) was adopted in February 2024 as an integral part of the AfCFTA Agreement. While the main protocol is adopted, negotiations continue for eight annexes covering areas such as Rules of Origin, Cross-Border Digital Payments, Cross-Border Data Transfers, Digital Identities, and Online Safety and Security. State parties will have 5 years to align national laws once the ratification process is complete.
• Africa's digital economy has significant growth potential, with estimates from 2020 by Google and the International Finance Corporation suggesting it could reach USD 180 billion by 2025 (5.2% of GDP) and USD 712 billion by 2050 (8.5% of GDP). If internet penetration reached levels seen in the Global North, the digital economy could add USD 2,200 billion to Africa's GDP and create 140 million jobs.
• The AfCFTA DTP consists of 52 articles across 11 parts. It covers a wide range of digital trade issues, including market access, electronic trust services, data governance (cross-border transfers and localization), business and consumer trust (cybersecurity and source code), and digital inclusion for MSMEs and skills development.
• The protocol emphasizes digital trade facilitation to reduce high import dwell times, which currently average more than 8 days for most African countries. It requires parties to update regulatory infrastructure for electronic transactions, including digital identities, invoicing, and authentication.
• The agreement includes provisions for Rules of Origin (ROO) to determine the origin of African-owned firms, content, and digital platforms. It also includes a provision, inspired by the WTO Moratorium, where parties agree not to impose customs duties on electronically transmitted digital products originating from other state parties.
• The protocol mandates the adoption of data protection, consumer protection, and cybersecurity laws to build trust. This addresses significant gaps: only 61% of 54 African countries have data protection laws, 72% have cybersecurity laws, and 52% have consumer protection laws applicable to online transactions.
• Implementation of the AfCFTA DTP faces several challenges, including significant digital infrastructure deficits (high costs and unreliable broadband), regulatory fragmentation across diverse states, and the need for extensive resources to support capacity building and digital skills development.
