WHERE DOES BRAZIL STAND WITH THE IMPLEMENTATION OF THE FOREST CODE?

The 2021 snapshot of the Brazilian Forest Code implementation shows that while rural property registration (CAR) is well advanced nationwide, the subsequent analysis and validation stages remain significant bottlenecks. Only six states have fully operational Environmental Compliance Programs (PRA), and a group of states in the Northeast, Roraima, and Rio Grande do Sul continue to lag in legislation and implementation. Progress in 2021 included the incipient rollout of 'dynamic analysis' tools in five states and the regulation of the PRA in Amapá, Ceará, and Minas Gerais.

• Registration in the Rural Environmental Registry (CAR) is well advanced in all states, with Roraima doubling its number of registrations in the last year. However, traditional peoples and communities in states such as Amazonas, Bahia, Maranhão, Pará, Pernambuco, and Piauí still require specific programs to advance.
• The analysis and validation of CAR data is the primary bottleneck for Forest Code implementation. While Espírito Santo has validated approximately 72% of its registrations (around 73,000), other states struggle with low quality registrations and communication issues; for example, in Pará, 45,000 of 47,000 analyzed registrations are pending producer responses.
• The 'dynamic analysis' tool, which automatically identifies inconsistencies and proposes corrections, was implemented in Amapá, Amazonas, Federal District, Paraná, and Rio de Janeiro in 2021, with plans to expand to 18 more states by the end of 2022.
• Full operationalization of the Environmental Compliance Program (PRA) is limited to six states: Acre, Bahia, Mato Grosso, Mato Grosso do Sul, Rondônia, and Pará. In other states, a lack of regulation prevents progress, with nine states—Alagoas, Espírito Santo, Paraíba, Piauí, Rio Grande do Norte, Rio Grande do Sul, Roraima, Sergipe, and Tocantins—lagging in building the necessary legal framework.
• There is a significant gap between CAR validation and the signing of commitment agreements for forest recovery. In Rondônia, only 5% of validated non-compliant registrations have signed terms, while in Mato Grosso and Pará, the figure is 20%.
• Financial incentives are being used to encourage CAR validation, including a 10% increase in credit limits for producers with validated CAR under the 2020/21 Agriculture Plan (Plano Safra).
