The IGF Mining Policy Framework is a detailed guide for governments to regulate the mining sector sustainably. It is organized into six pillars: laws and institutions, financial benefits, socio-economic benefits, environmental management, mine closure transition, and artisanal and small-scale mining (ASM). The framework emphasizes transparency, gender equality, human rights, and the protection of indigenous peoples. • Governments should establish a consolidated geological database using a Geographic Information System (GIS) and the UN Framework Classification for Resources (UNFC) to strategically manage mineral resources.
• Mining tax regimes should be designed to optimize government revenue while remaining attractive to investors, with a recommended average effective tax rate for profitable projects between 40% and 60%.
• To prevent tax avoidance, governments are advised to implement measures against base erosion and profit shifting (BEPS) and align transfer pricing with OECD or UN guidelines.
• Permit issuance must be conditional on the submission of an integrated Environmental and Social Impact Assessment (ESIA) that includes climate change risks and gender-disaggregated socio-economic data.
• Governments must ensure that indigenous peoples' rights are respected by obtaining their free, prior, and informed consent (FPIC) before authorizing mining activities on their lands.
• Mining operations should be required to implement a mitigation hierarchy—avoid, minimize, restore, and offset—to ensure no net loss of biodiversity.
• Comprehensive mine closure plans and adequate financial assurance must be approved before construction begins to ensure the state is not burdened with cleanup costs if an operator fails.
• For abandoned mines, governments should create an inventory and risk assessment to prioritize remediation plans, particularly for high-risk sites.
• Artisanal and Small-scale Mining (ASM) should be integrated into formal legal and economic systems through simplified permitting and technical training to improve livelihoods and environmental performance.
• Governments should actively work to eliminate the use of mercury and other toxic substances in ASM, aligning with the Minamata Convention.
