CADRE D’ORIENTATION DES POLITIQUES MINIÈRES

The 2023 Mining Policy Framework (MPF), published by the International Institute for Sustainable Development (IISD) on behalf of the Intergovernmental Forum on Mining, Minerals, Metals and Sustainable Development (IGF), provides a comprehensive set of international best practices for the governance of the mining sector. The framework is designed to help governments ensure that mining activities contribute to sustainable development across six key domains: laws and institutions, financial benefits, socio-economic benefits, environmental management, post-mining transition, and artisanal and small-scale mining (ASM).

• The Mining Policy Framework (MPF) establishes a systemic approach to mining governance across the entire mine life cycle, from exploration to closure. It is used by the IGF to conduct national assessments to identify gaps in existing laws and provide tailored technical assistance and capacity building for member governments.
• Effective legal and institutional frameworks require the collection of geological data, clear coordination of government roles, and the regular updating of codes and contracts to align with international standards. The framework emphasizes that mining contracts should be negotiated by multidisciplinary teams and be accessible to the public.
• The framework mandates rigorous permitting processes, requiring mining entities to conduct integrated social and environmental impact assessments and obtain free, prior, and informed consent from indigenous peoples where applicable. Notably, it advises against granting permits for deposits located in active armed conflict zones.
• Financial governance should focus on optimizing public revenue through clear tax regimes that adjust based on project profitability and prevent tax avoidance. The framework calls for full public disclosure of all payments made by mining companies and received by the government.
• Socio-economic benefits are maximized by integrating mines into local development plans, prioritizing local procurement, and ensuring labor rights. This includes prohibiting forced and child labor and increasing the participation of women and indigenous peoples in the workforce.
• Environmental management priorities include reducing greenhouse gas emissions to meet international climate goals, protecting water sources through basin-level planning, and implementing a mitigation hierarchy to avoid net loss of biodiversity.
• Sustainable post-mining transitions require comprehensive closure plans and adequate financial assurance provided before operations begin. These plans must ensure the land is returned to a productive, climate-resilient use and include independent audits of closure obligations.
• For artisanal and small-scale mining (ASM), the framework recommends creating specific legal frameworks to formalize operators, providing technical training to improve productivity and safety, and taking active measures to eliminate the use of mercury and other toxic substances.
