Le protocole numérique de la ZLECAf vue d'ensemble

The AfCFTA Protocol on Digital Trade, adopted in February 2024, aims to create a comprehensive regulatory framework to facilitate digital commerce across Africa. It covers 52 articles across 11 sections, addressing market access, data governance, and digital inclusion. While it mirrors advanced global models like the CPTPP, it includes specific provisions for digital inclusion and capacity building to support Least Developed Countries. However, its success depends on overcoming significant infrastructure gaps, regulatory fragmentation, and the completion of eight pending annexes.

• The AfCFTA Protocol on Digital Trade (PCN) was adopted in February 2024, though negotiations for eight specific annexes remain ongoing. These annexes cover critical areas including rules of origin, cross-border digital payments, data transfers, source code requests, digital identities, fintech, emerging technologies, and online safety and security.
• The digital economy in Africa has significant growth potential; by 2025, it could reach 180 billion USD (5.2% of GDP), and by 2050, it could reach 712 billion USD (8.5% of GDP). If internet penetration reached Northern levels, it could add 2,200 billion USD to Africa's GDP and create 140 million jobs.
• The Protocol focuses on digital trade facilitation by requiring states to update regulations on electronic transactions, trust services, and digital identities to reduce trade delays. This is critical as African countries currently face the highest average import delays, with customs procedures often exceeding 8 days.
• The Protocol includes provisions for market access and data governance, promoting the free flow of data and prohibiting requirements for source code access as a condition for market entry, though exceptions for national security and public policy are permitted.
• There is a significant gap in the regulatory frameworks necessary for digital trust across Africa. Only 61% of 54 African countries have data protection laws, 72% have cybersecurity laws, and 52% have consumer protection laws applicable to online transactions.
• The Protocol is innovative in its explicit focus on digital inclusion, targeting the digital divide for micro, small, and medium enterprises (MSMEs) and promoting digital skills and entrepreneurship, which are less common in other digital trade agreements.
• Implementation of the Protocol faces three primary challenges: significant infrastructure deficits (limited internet access and high costs), the difficulty of harmonizing regulations across diverse development levels, and the need for substantial resources for capacity building.
