NOVO CÓDIGO FLORESTAL

This policy brief by the Climate Policy Initiative describes the 2012 Brazilian Forest Code, detailing its mechanisms for protecting native vegetation on private lands, the creation of the Rural Environmental Registry (CAR), and the special legal regime for regularizing properties with environmental liabilities prior to July 22, 2008.

• The new Forest Code relies on two primary instruments for environmental conservation on private lands: Permanent Preservation Areas (APP) and the Legal Reserve. APPs are sensitive areas where vegetation must be preserved to maintain essential environmental services, and economic exploitation of forest resources is prohibited. The Legal Reserve requires a percentage of a rural property's total area to maintain native vegetation, with percentages ranging from 20% to 80% depending on the region and vegetation type.
