Panorama dos Direitos de Propriedade no Brasil Rural: Legislação, Gestão Fundiária e Código Florestal

This report examines the historical and systemic issues of land tenure in rural Brazil, highlighting how irregular property rights, fragmented registration systems, and the lack of a unified cartographic base contribute to social conflict, illegal deforestation, and challenges in implementing the Forest Code.

• Brazil's rural land tenure is characterized by widespread irregularity, where thousands of properties lack titles and some municipalities have registered areas that exceed their actual territorial surface by one or more times. This lack of control has facilitated 'grilagem' (illegal appropriation of public lands by private individuals) and resulted in territorial overlaps due to the absence of a single land registry combining geographic and legal information.
• The current rural registration system is fragmented, consisting of multiple registries for fiscal, economic, land planning, and environmental purposes that operate without coordination or a shared cartographic base. This lack of data accuracy leads to legal insecurity and conflicts, and there is no joint registry for federal and state public lands with reliable information.
• The Rural Environmental Registry (CAR), established by the Forest Code, has improved environmental planning and the fight against illegal deforestation, but its lack of integration with other rural registries is a missed opportunity to combat land grabbing and resolve land conflicts. The report notes that the success of the Forest Code depends on resolving land tenure issues to properly identify those environmentally responsible.
• While private property is more consolidated, collective land tenure and small farmers face significant barriers to securing territorial rights. This includes Indigenous Lands, quilombola territories, Conservation Units, and agrarian reform settlements, all of which are hindered by long regularization processes, land conflicts, and political and economic pressures.
• The new Forest Code lacks clear guidelines on how to be applied to cases of collective land tenure, despite these categories covering significant territorial extensions and often containing native vegetation.
