A CITIZEN’S GUIDE TO THE WORLD BANK INSPECTION PANEL

A 1999 guide by CIEL explaining how citizens can use the World Bank Inspection Panel to report policy violations in development projects. It details eligibility criteria, the investigation process, the limitations of the Panel's power, and the risks of borrower reprisals.

• The World Bank Inspection Panel is a quasi-independent body established in 1993 to hold the World Bank accountable for violations of its own social and environmental policies and procedures. It consists of three members nominated by the Bank President and approved by the Board of Executive Directors, serving five-year terms.
• To be eligible to file a claim, two or more individuals must be directly affected by alleged policy violations, demonstrate that they have or are likely to suffer material adverse effects, and show that they attempted to raise concerns with Bank Management without a satisfactory response. Claims are barred if the project is substantially complete, defined as 95% or more of the funds being disbursed.
• The Inspection Panel's jurisdiction is limited to the International Bank for Reconstruction and Development (IBRD) and the International Development Association (IDA). It does not have jurisdiction over projects financed by the International Finance Corporation (IFC) or the Multilateral Investment Guarantee Agency (MIGA), though a Compliance Advisor/Ombudsman (CAO) was created in July 1999 to address complaints regarding those entities.
• The process for an investigation requires a recommendation from the Panel and subsequent approval by the Board of Executive Directors. Historically, this stage has been subject to political manipulation, with Bank Management sometimes promoting 'Action Plans' as alternatives to full investigations to avoid scrutiny of policy violations.
• The Inspection Panel cannot provide financial compensation, issue injunctions to stop project work, or order the cancellation of a project. Its findings are advisory to the Board of Executive Directors, which decides on the final remedial action.
• Filing a claim can lead to positive indirect outcomes, such as increased project supervision, the creation of independent monitoring bodies, and heightened international media attention, even if a full investigation is not conducted.
• Claimants face a significant risk of reprisals from project authorities or governments after filing a claim. While the Panel can keep identities confidential, it has no mandate to prevent forced evictions or other retaliatory actions by borrowers.
