OBJECTIONS TO THE FINAL SCOPING ASSESSMENT REPORT OF THE PROPOSED MUSINA- MAKHADO SPECIAL ECONOMIC ZONE, LOCATED WITHIN THE VHEMBE DISTRICT MUNICIPALITY OF THE LIMPOPO PROVINCE

The Centre for Environmental Rights (CER), representing groundWork and Earthlife Africa, submitted formal objections on November 1, 2019, to the Final Scoping Assessment Report (FSR) for the proposed Musina-Makhado Special Economic Zone (also known as the Energy Metallurgical Special Economic Zone or EMSEZ). The CER argues that the FSR is fatally flawed due to inadequate public participation, a failure to conduct a Strategic Environmental Assessment (SEA), and the appointment of an incorrect competent authority. The document details severe concerns regarding the project's impact on water scarcity, climate change, air quality, and biodiversity in the Limpopo Province.

• The CER asserts that a Strategic Environmental Assessment (SEA) must be conducted before any individual Environmental Impact Assessments (EIAs) for the EMSEZ because the project's massive scale and cumulative impacts cannot be captured by project-specific EIAs. The CER suggests an SEA scope of at least 100 km in all directions to account for transboundary air pollution and downstream water effects.
• The CER argues that the Limpopo Department of Economic Development, Environment and Tourism (LEDET) is the incorrect competent authority. They contend that because the Limpopo Economic Development Agency (LEDA) is a statutory body, the Minister of Environment, Forestry and Fisheries must be the designated authority under section 24C(2)(d)(iii) of the National Environmental Management Act (NEMA).
• The proposed EMSEZ is criticized for being inconsistent with South Africa's international climate commitments under the Paris Agreement and the IPCC's 1.5°C warming limit. Specifically, the plan for a 3,300 MW coal-fired power station is viewed as a violation of the constitutional right to a healthy environment.
• The FSR's analysis of water availability is described as extremely flawed and contradictory. The CER notes that while the FSR admits a sustainable water source is still under investigation, it suggests importing 30 million m3 per annum from the Zimbabwe National Water Authority and the Zhove Dam, which could negatively impact downstream users and ecosystems.
• The CER identifies significant risks to air quality and public health, noting that the project is located in a non-attainment priority area. They argue the FSR fails to provide a baseline assessment of air quality or estimate the specific volumes of harmful pollutants like mercury, cadmium, and lead that will be emitted.
• The project is flagged for its potential irreversible impact on critical biodiversity and cultural heritage sites. This includes the Vhembe UNESCO Biosphere Reserve, the Mapungubwe Cultural Landscape (a UNESCO World Heritage site), and several nature reserves (Musina, Blouberg, Langjam, and Nwanedi).
• The CER claims the public participation process was 'woefully inadequate,' citing the failure to register the CER and its clients as interested and affected parties (I&APs) until July 2019, despite requests made in December 2018. They also argue that the one-month comment period was insufficient for a 600-page technical document.
• The FSR is accused of failing to properly motivate the 'need and desirability' of the project, relying instead on general alignment with national policies like the National Development Plan 2030 rather than project-specific ecological or socio-economic evidence.
• The CER highlights a lack of data regarding the cumulative impacts of the coal mines intended to supply the EMSEZ. The FSR mentions over 104,000 ha of proposed new coal mines, including the Mopane, Chapudi, Makhado, Generaal, and Vele projects, but provides no environmental assessment for them.
