The Minister of Environment, Forestry and Fisheries of South Africa dismissed appeals brought by the Centre for Environmental Rights and the North Western Cape Mining Forum against an Environmental Authorisation (EA) granted to Mineral Sands Resources (Pty) Ltd. The EA was issued under section 24G of the National Environmental Management Act (NEMA) to rectify the unlawful commencement of listed activities—specifically the clearance of vegetation and the construction of a process water dam—on the farm Geelwal Karoo 262 in the Western Cape Province.

This document consists of a series of annexures related to the proposed extension of the Tormin Mineral Sands Mine on the West Coast of South Africa. It includes a Background Information Document (BID) and an Executive Summary of an Environmental Impact Assessment (EIA) report prepared by SRK Consulting for Mineral Sand Resources (Pty) Ltd (MSR). The documents detail plans to expand mining of Valuable Heavy Minerals (VHM) across ten beaches and an inland strandline, alongside infrastructure upgrades. The annexures also contain extensive legal correspondence and an appeal from the Centre for Environmental Rights (CER), which challenges the lawfulness of the extension process, alleges previous environmental violations by MSR, and disputes the adequacy of the impact assessments regarding Critical Biodiversity Areas (CBAs).

This supporting expert affidavit, submitted by Associate Professor Merle Sowman, argues that the Environmental Impact Assessment (EIA) for the proposed extension of the Tormin Mine by Mineral Sands Resources (Pty) Ltd (MSR) failed to adequately assess cumulative environmental and socio-economic impacts. Sowman contends that assessing applications on an ad hoc basis ignores the broader scale of MSR's regional mining plans and calls for a Strategic Environmental Assessment (SEA) to prevent irreversible damage to critical biodiversity areas and sensitive coastal ecosystems.

This Terrestrial Ecology Specialist EIA report, produced by Simon Todd Consulting for SRK Consulting, assesses the ecological impacts of the proposed expansion of the Tormin Mineral Sands Mine on the West Coast of South Africa. The expansion includes ten beach mining areas, an inland 'Strand line' mining area on farm Geelwal Karoo 262, and an infrastructure/plant expansion area. The study concludes that while the project will result in moderate habitat loss, it is environmentally acceptable provided specific mitigation measures—such as rotational mining and topsoil management—are implemented.
