A Posse of Guns for Hire

This research paper examines the intersection of poor governance and the presence of unemployed former combatants in Africa, using the foiled 2004 coup attempt in Equatorial Guinea as a case study to highlight the risks of mercenary activity and the inadequacy of current legal frameworks.

• The 2004 foiled coup attempt in Equatorial Guinea demonstrated how poor governance and a large population of idle former soldiers and guerrilla fighters create a market for mercenary activity. Johann Smith, a former South African Defense Force commander, estimated there are between 2,500 and 3,000 such individuals in South Africa, suggesting further incidents are likely due to their economic circumstances.
• Despite disarmament, demobilisation, and reintegration efforts—including a $500 million World Bank allocation for Africa’s Great Lakes region—integrating unskilled former soldiers into slow economies remains difficult. In Namibia, Mozambique, and South Africa, many former cadres lack the skills for civilian life; a 2001 Institute for Security Studies report found that 37% of ex-combatants from both sides of the apartheid divide were unemployed.
• Many of the individuals arrested in Zimbabwe in March 2004 for plotting mercenary activities in Equatorial Guinea were black former soldiers from the South African Defense Force's 32 Battalion, including individuals from Namibia, Angola, and Congo who had been granted South African citizenship.
• Legal frameworks to curb mercenary activity in Africa are viewed as weak. The African Union has not reviewed the 1977 Convention for the Elimination of Mercenarism in Africa. While South Africa's 1998 Regulation of Foreign Military Assistance Act led to the closure of Executive Outcomes, critics argue it did not sufficiently tighten the legal environment for mercenaries.
