The interface between Access and Benefit-Sharing and Biotrade in Namibia: Exploring potential areas of synergy

This research paper explores the relationship between Access and Benefit-Sharing (ABS) frameworks and biotrade in Namibia, specifically focusing on how to implement the Nagoya Protocol without hindering the commercialisation of biological resources.

• Namibia is currently developing comprehensive ABS legislation based on its existing regulatory and administrative frameworks to comply with the Nagoya Protocol. The primary goal is to establish a mutually supportive relationship where ABS implementation and the promotion of biotrade occur simultaneously.
• There is a lack of clarity regarding how ABS policy frameworks apply to biotrade businesses, despite most of these businesses adhering to sustainable biodiversity principles. The Nagoya Protocol is intended to resolve this by defining the scope of ABS and the responsibilities of provider and user countries.
• Evidence from South Africa suggests that applying ABS regulations to existing biotrade businesses can lead to negative outcomes, including broader economic losses and the further marginalisation of poor communities and women.
