Report of the ISS Seminar: Analysis of the 12th Ordinary Summit of the African Union (AU) Heads of State and Government

• Mr. Ibrahima Kane identified several legal challenges associated with the AU Assembly's decision to transform the Commission into an Authority, including issues regarding the loss of sovereignty, cessation of power, the relationship between the AU Commission and Regional Economic Communities (RECs), and the necessity for amendments to the AU Constitutive Act.
• Ambassador Akuei Malwal discussed the AU's response to the International Criminal Court's (ICC) indictment of the President of Sudan and other officials. He noted that AU Decision 142 established measures to investigate if Sudan's national judicial institutions could prosecute violence in Darfur, and warned that the ICC indictment could destabilize the Comprehensive Peace Agreement (CPA) and peace talks in Doha.
