Provide Guinea-Bissau with a new constitution to strengthen the rule of law and stability

This policy brief argues that Guinea-Bissau requires a new constitution to resolve political deadlocks and clarify the powers of state organs, noting that previous reform efforts by the National People’s Assembly were stalled by the 2015 political crisis.

• The existing Basic Law of Guinea-Bissau is characterized by a lack of precision and clarity, particularly regarding the competencies and powers of state organs. A new constitution is proposed to increase state efficiency, ensure fairer service delivery, and prevent political deadlocks.
• Efforts to reform the constitution were initiated by the National People’s Assembly (NPA) via an ad hoc committee following the 2014 elections, but these efforts were halted by the political crisis of 2015.
• The United Nations Integrated Peacebuilding Office in Guinea-Bissau (UNIOGBIS), established in 2009, has a mandate under resolution 2404 of 28 February 2018 to assist national authorities in the review of the Constitution, alongside other priorities such as implementing the Conakry Agreement and supporting the 2018 legislative elections.
