MINING POLICY FRAMEWORK

The 2023 Mining Policy Framework (MPF) provides a comprehensive set of guidelines for governments to manage the full mining life cycle. It is organized into six pillars: laws, policies, and institutions; financial benefits; socio-economic benefits; environmental management; post-mining transition; and artisanal and small-scale mining (ASM). The framework emphasizes the need for transparent fiscal regimes, inclusive community engagement, rigorous environmental protections—including climate change adaptation and greenhouse gas emission reductions—and the formalization of the ASM sector to improve livelihoods and safety.

• The framework establishes that a modern legislative regime must provide clear accountability and include the generation of baseline geological data and public access to cadastral information to ensure consultations occur on an equal footing.
• Regarding financial governance, the MPF advocates for fiscal regimes based on quantitative analysis that optimize government revenues and limit tax avoidance through measures against base erosion and profit shifting.
• Socio-economic guidelines emphasize the protection of human rights and the requirement for mining entities to obtain free, prior, and informed consent from Indigenous peoples when applicable.
• Environmental management standards require the adoption of greenhouse gas emission controls to meet international climate goals and the integration of climate change risks into watershed-level water planning.
• The framework mandates that mine closure plans be submitted as a prerequisite for permit applications and must include adequate financial assurance to fund closure and ongoing monitoring.
• For artisanal and small-scale mining (ASM), the framework recommends developing specific legal frameworks to integrate operators into the formal economy and taking steps to eliminate the use of mercury and other toxic substances.
