Development Issues for the Thirteenth Ministerial Conference—Deal Breaker or Game Changer?

This research paper analyzes two critical development issues facing the World Trade Organization (WTO) ahead of the Thirteenth Ministerial Conference (MC13): the operationalization of special and differential treatment (SDT) for developing economies and the transition process for Least Developed Countries (LDCs) graduating from their category.

• Developing countries and LDCs, who make up 75% of the WTO, argue that existing special and differential treatment (SDT) provisions are often too vague or use 'hortatory language', lacking the predictability and certainty required for implementation. While a mandate to strengthen these provisions was established at the 2001 Fourth Ministerial Conference, progress has been stalled by developed countries' concerns that the proposals seek 'blanket and indefinite exemptions from WTO rules'.
• The G90—a group comprising the African Group, the LDC Group, and the Group of African, Caribbean and Pacific countries—has narrowed its priority SDT proposals to 10 agreement-specific items. In February 2023, South Africa submitted a detailed justification for these 10 proposals, clarifying they are 'specific, time-bound, and clearly stated flexibilities' rather than indiscriminate exemptions, with the goal of achieving outcomes by MC13.
• There is a pressing need to manage the transition of LDCs as they graduate from their category to avoid a 'sudden loss of international support measures' that could reverse developmental progress. Ten of the 35 WTO LDC members and four of the eight acceding LDCs are currently on the path to graduation. The LDC Group is seeking extended preferential market access (duty-free, quota-free exports) and continued access to LDC-specific flexibilities and capacity-building assistance for a set period post-graduation.
• A significant breakthrough regarding LDC graduation occurred on October 23, 2023, when the WTO General Council adopted a decision encouraging members to provide a 'smooth and sustainable transition period' for withdrawing duty-free and quota-free preference programs. The LDC Group is now attempting to leverage this momentum to secure agreements on other flexibilities and capacity-building assistance by MC13.
