Development Issues for the Thirteenth Ministerial Conference—Deal Breaker or Game Changer?

The paper examines two critical development issues facing the WTO ahead of MC13: the operationalization of special and differential treatment (SDT) provisions and the support for LDCs graduating from their category. While the G90 has narrowed its SDT proposals to 10 priority items to address developed countries' concerns about 'blanket and indefinite exemptions', consensus has remained elusive. Conversely, there is positive momentum regarding graduating LDCs following a October 2023 General Council decision encouraging smooth transitions for duty-free and quota-free preference programs.

• Developing countries and LDCs argue that the 157 existing SDT provisions in WTO agreements are often too vague or use 'hortatory language', lacking the predictability and certainty required for effective implementation.
• The G90—comprising the African Group, the LDC Group, and the Group of African, Caribbean and Pacific countries—has reduced its priority SDT proposals to 10 agreement-specific items to seek outcomes by MC13, clarifying that these are 'time-bound, and clearly stated flexibilities' rather than indefinite exemptions.
• There is a risk that graduating LDCs may lose progress or revert to LDC status if they experience a 'sudden loss of international support measures' due to structural weaknesses and global crises.
• A significant step toward supporting graduating LDCs occurred on October 23, 2023, when the WTO General Council adopted a decision encouraging members to provide a 'smooth and sustainable transition period' for the removal of duty-free and quota-free preference programs.
