• Level 1 partners must implement specific environmental and climate governance measures, including the adoption of net-zero policies and the integration of climate change risk disclosure using frameworks such as the CDP or ISSB.
• The Code mandates a zero-tolerance approach to corruption, bribery, fraud, and tax evasion across the delivery chain. Level 1 partners are specifically required to provide full delivery chain transparency and support MSMEs by paying undisputed invoices within 30 days.
• Human rights protections are central to the Code, with a specific focus on managing risks in fragile and conflict-affected states (FCAS). Level 1 partners must be UN Global Compact participants and implement due diligence to prevent slavery and human trafficking in their delivery chains.
• All partners must comply with anti-money laundering and counter-terrorism financing laws, specifically citing the Anti-Money Laundering and Combating of Terrorism Financing Laws (Amendment) Act 2023 of Kenya.
• Level 1 partners with multi-year contracts are required to submit an annual Compliance Declaration and may be subject to spot check monitoring to verify their adherence to the Code.
