- Article 42 of the Forest Code (Law 12.651/2012) contains a drafting error that makes the creation of its proposed fine conversion program legally impossible. It requires the fine to be based on Article 50 of Decree 6.514/2008, but also requires the vegetation suppression to have occurred before July 22, 2008; however, Decree 6.514/2008 only came into effect on July 23, 2008.
- To improve the instrument, the authors recommend establishing a new federal regulation (via decree or normative instruction) that defines the final fine value, the list of eligible services (including Environmental Reserve Quotas), deadlines for requests and decisions, and project approval guidelines.
