FORTALECENDO OS ESTUDOS AMBIENTAIS DE CONCESSÕES FEDERAIS DE INFRAESTRUTURA TERRESTRE

The policy brief evaluates the quality and consistency of socio-environmental analyses in federal railway and highway concessions in the Legal Amazon. It finds that these studies often prioritize socio-economic and physical factors over biotic ones, fail to align with international guidelines or sectoral manuals, and frequently do not fully comply with their own terms of reference (TRs). The authors recommend incorporating international guidelines into TRs, making sectoral manuals binding, and establishing transparent approval processes to ensure full compliance.

• Socio-environmental studies for infrastructure projects prioritize socio-economic and physical environments over the biotic environment (flora and fauna). In EVTEAs, this emphasis reflects a focus on technical and economic viability, missing the chance to integrate robust biotic analysis before environmental licensing.
• There is a significant overlap between EVTEAs and EIAs, with approximately 30% of components analyzed in EIAs also appearing in EVTEAs. This suggests that mandatory correlation between the two could increase efficiency and allow EVTEAs to anticipate analyses typically reserved for the EIA phase.
• Federal infrastructure studies do not fully adhere to sectoral manuals. On average, railway sector studies incorporated 47% of components from the VALEC manual, while highway sector studies incorporated 54% of components from the DNIT manual.
• The analyzed studies fail to incorporate all ten most relevant socio-environmental components identified by international guidelines. Specifically, 'riverine communities' (comunidades ribeirinhas) were not included in any of the reviewed studies.
• Compliance with Terms of Reference (TRs) is inconsistent. While some highway EVTEAs complied with their TRs, railway EVTEAs and all analyzed EIAs failed to fully meet the requirements set out in their respective TRs.
• Transparency in the sector is low; for the 14 analyzed project sections, only one (Ferrogrão) provided complete information across all environmental studies and their corresponding terms of reference.
• The authors recommend that socio-environmental components from sectoral manuals be included in EVTEA terms of reference or procurement notices to make them binding, and that a transparent process be established to ensure full compliance with TRs and manuals.
