FOREST CODE COMPLIANCE FLOWCHART FOR RURAL PROPERTIES ≤ 4 FISCAL MODULES

This document is a compliance flowchart for rural properties of 4 fiscal modules or less, detailing the requirements for the regularization of Permanent Preservation Areas (APP) and Legal Forest Reserves under the Forest Code.

• Rural properties with 4 fiscal modules or less have flexible APP restoration requirements based on property size: the APP will not exceed 10% of the property for those ≤ 2 fiscal modules, and 20% for those between 2 and 4 fiscal modules.
• The flowchart identifies specific restricted use areas where clear-cutting existing native vegetation is forbidden, including watercourses, springs, lakes or ponds, veredas, plateaus, hill tops, and slopes with a declivity greater than 45º or altitudes above 1,800 m.
• Regularization of the Legal Forest Reserve for these properties is based on the native vegetation present prior to July 2008, even if that amount is less than what is generally foreseen in the Forest Code.
