A blueprint for an effective watchdog

ClientEarth proposes a blueprint for a UK environmental watchdog with binding legal powers, independent funding from parliament, and a UK-wide mandate to ensure government accountability for environmental obligations.

• The proposed watchdog must possess strong legal powers to ensure it is not a 'box-ticking' exercise, including the ability to conduct inquiries into systemic policy problems, review government plans for parliamentary debate, and issue binding action plans and compliance notices enforceable by courts.
• To maintain independence and prevent ministerial interference, the body should be funded directly by parliament, have key staff appointed by parliament, and be accountable to parliament rather than government departments.
• The watchdog requires adequate resources and a multidisciplinary staff of experts in law, science, planning, and philosophy. ClientEarth suggests budget comparisons with the National Audit Office (£63.1m), the Information Commissioner’s Office (£25m), and the Equality and Human Rights Commission (£18m).
• The body should operate on a UK-wide basis through a co-designed and co-owned joint watchdog to address the governance gap created by leaving the EU, covering all devolved parts of the country from the Scottish Highlands to the Welsh coast.
