A HANDBOOK FOR OBTAINING DOCUMENTS FROM THE WORLD TRADE ORGANIZATION

This guide, authored by L. Brennan Van Dyke and John Barlow Weiner of the Center for International Environmental Law (CIEL), provides instructions for non-specialists and NGOs on how to access documents from the World Trade Organization (WTO). It details the processes for automatic and requested derestriction of documents and advocates for greater transparency to allow civil society to influence international trade rules.

• The WTO established procedures in July 1996 to allow public access to documents, but many critical documents remain 'restricted' and are only available to the public after they are 'derestricted.' Some documents can remain restricted indefinitely if a single Member objects to their release.
• Certain documents are automatically derestricted upon the occurrence of a specific event, such as the completion of a report or a final decision by a WTO body. However, these events may be delayed or never occur if the issue is sensitive or complicated.
• For documents not automatically derestricted, a Member can request that a WTO body (such as the General Council or Ministerial Conference) consider derestriction at its next meeting. Alternatively, a Member can request that the general WTO Membership consider it, a process where the document is derestricted after 60 days if no Member objects.
• CIEL recommends that the WTO limit document restriction to a case-by-case basis, specifically for protecting proprietary interests or international security. They suggest that the WTO should redact specific information rather than restricting entire documents and provide explanations for any restrictions.
• The guide advises NGOs and private citizens to pressure their national governments to demand greater transparency at the WTO. It suggests that by highlighting how a lack of transparency hinders the quality of their input to national representatives, NGOs can better argue for policy changes.
