Concerns about GU-L1086: Border Integration Guatemala Mexico

The Center for International Environmental Law (CIEL) expresses concerns regarding a proposed $200 million Inter-American Development Bank (IDB) loan to Guatemala for border integration between Guatemala and Mexico. CIEL argues that the project's lead agency, the Guatemala Ministry of Defense, lacks the legal mandate for fiscal and economic controls, suffers from a lack of transparency, and has documented links to corruption and organized crime. Additionally, CIEL warns that the program's focus on migrant control may violate international legal obligations regarding refugee rights and freedom of movement.

• The IDB has proposed a $200 million loan to Guatemala to improve competitiveness and security by implementing fiscal, parafiscal, and migratory controls at border crossings. The program aims to reduce operational costs for commercial entities, decrease transit times for people and products between Guatemala and Mexico, and increase authority presence. The Guatemala Ministry of Defense is the designated executing agency responsible for all technical, administrative, and fiduciary duties.
• CIEL asserts that the Ministry of Defense is an inappropriate lead agency because the project's objectives fall outside its legal mandate. Under Guatemalan law, fiscal controls, tariff policies, and economic integration initiatives are the responsibility of the Superintendencia de Administración Tributaria (SAT) and the Ministry of the Economy. There are concerns that using the Defense Ministry could lead to the "usurpation of duties" under Article 335 of the Guatemalan penal code.
• The Guatemala Ministry of Defense faces significant issues regarding transparency, accountability, and integrity. Transparency laws do not apply to all its contracts, and the Law on State Contracting exempts the Ministry from public bidding for various purchases, including arms, fuel, and vehicles. Furthermore, reports from the UN-backed CICIG and U.S. contractor CNA indicate that criminal organizations have penetrated high levels of the military and that military arsenals have been intentionally diverted to the black market.
• The program may conflict with U.S. Congressional objectives and international human rights law. The U.S. FY16 appropriations bill allowed for withholding 50% of Alliance for Prosperity funds if Guatemala failed to curtail the military's role in civilian policing and improve transparency. Additionally, the project's goal of "better border control of migrants" may violate the American Convention of Human Rights and the Convention on the Status of Refugees, specifically regarding the principle of non-refoulement and the right to seek asylum.
• The IDB's legal framework for the project fails to identify Guatemala's obligations to indigenous communities under ILO Convention 169.
