Synthesis of Statements on Climate Change

This briefing by the Center for International Environmental Law and the Global Initiative for Economic, Social and Cultural Rights synthesizes the 2022 activities of the Committee on Economic, Social and Cultural Rights (CESCR) regarding climate change. • In 2022, the CESCR was the most frequent committee to reference climate change in its State review outputs, addressing the issue in recommendations or questions for 21 out of 27 reviewed States. Of these outputs, 38 percent were directed at developed States. The Committee focused on mitigation policies in 17 outputs, often citing the Paris Agreement, and adaptation in 15 statements, frequently referencing national adaptation plans (NAPs).
• The CESCR specifically challenged several States on their climate commitments and energy policies. It noted that Bahrain was not on track to meet its nationally determined contribution (NDC) or greenhouse gas (GHG) emission reduction targets because of its "oil and gas industry." The Committee recommended that Italy increase the taxation of emissions to meet its Paris Agreement contributions and urged the replacement of fossil fuels in its energy mix with renewable energy. Additionally, the Committee questioned Australia regarding the reconciliation of its continued support for coal exports and mines with its obligations under the Covenant.
• The Committee expressed concern over the role of financial institutions in climate change, particularly regarding investments in carbon-intensive sectors. In its observations to Luxembourg, the CESCR highlighted a lack of regulation and transparency in the financial sector and recommended measures to decrease both public and private investments in fossil fuels and other activities incompatible with GHG emission reductions.
• The CESCR published General Comment No. 26 (2022) on land and economic, social and cultural rights, which asserts that mitigation policies must result in absolute emissions reductions by phasing out the use and production of fossil fuels. The document warns that mitigation measures, such as reforestation or large-scale renewable energy projects, can undermine Covenant rights if not managed properly. It emphasizes that cooperation mechanisms for these measures must include environmental and social safeguards, meaningful consultation, and the free, prior, and informed consent of Indigenous Peoples.
• General Comment No. 26 establishes that States have extraterritorial obligations to ensure their domestic and international policies—including those related to energy, investment, trade, and climate change mitigation—do not interfere with the enjoyment of human rights outside their own territories. It further states that international agreements in these areas must be consistent with Covenant obligations and must not adversely affect access to productive resources in other countries.
