Leveraging the ICJ Climate Ruling at COP30 to Unlock Ambition and Advance Accountability: A Pocket Guide for Negotiators and Allies

A guide published by CIEL and other organizations detailing how the International Court of Justice's July 2025 Advisory Opinion on climate change obligations can be used by negotiators at COP30 to increase climate ambition and accountability.

• On 23 July 2025, the International Court of Justice (ICJ) issued an Advisory Opinion establishing that States have a legal duty to prevent significant climate harm. This duty requires stringent due diligence aligned with equity, the principle of common but differentiated responsibilities and respective capabilities (CBDR-RC), and cooperation to protect the human rights of future and current generations.
• The ICJ ruling is intended to serve as a tool for negotiators at the COP30 climate talks in November 2025 to advance climate justice and ambition. The guide specifically addresses the ruling's application to areas including finance, climate science, mitigation, adaptation, loss and damage, just transition, Nationally Determined Contributions (NDCs), human rights, Indigenous Peoples, gender, corporate capture, and UNFCCC reform.
