Promoting Human Rights in the Future Climate Regime

This commentary by the Center for International Environmental Law argues that the international climate change regime has historically failed to address the human rights implications of both climate change and the implementation of climate policies, and suggests that the Durban Platform for Enhanced Action (ADP) provides opportunities to rectify this.

• Climate change impacts human rights through extreme weather and slow onset changes, while the implementation of mitigation and adaptation policies can lead to the infringement of rights for local communities and indigenous peoples.
• The international climate change regime has generally failed to address human rights implications, only acknowledging the need for parties to respect human rights during the implementation of the Framework Convention in 2010.
• The Durban Platform for Enhanced Action (ADP), along with institutional reforms and new mechanisms, presents opportunities to fulfill human rights obligations, protect stakeholder rights, and establish a redress mechanism for climate-related loss and damages.
