Compliance Check: European Parliament's TTIP Resolution on Public Health, Environment and Democracy Risk

The Center for International Environmental Law (CIEL) conducted a preliminary compliance assessment to determine if the European Commission followed the European Parliament's July 2015 recommendations regarding the Transatlantic Trade and Investment Partnership (TTIP), specifically concerning public health, environment, and democracy.

• The analysis concludes that the European Commission did not adhere to the European Parliament's recommendations. Specifically, the Commission failed to avoid negotiations in areas with divergent EU and US rules, failed to prevent TTIP from impacting the EU regulatory process, and failed to implement meaningful reforms to the investor-state dispute settlement (ISDS) mechanism.
• The assessment is characterized as preliminary because of restricted public access to negotiating positions and proposals. A complete evaluation would require the full release of negotiating texts and an analysis of the United States' reforms to the Toxic Substances Control Act (TSCA) and the uncertainties resulting from the Brexit referendum in the United Kingdom.
