A letter from the South African Department of Environmental Affairs to Eskom regarding an application for the postponement of compliance time-frames with the National Environmental Management: Air Quality Act 39 of 2004 for the Kendal Power Station.

• The National Air Quality Officer denied the request to postpone compliance with Particulate Matter (PM) limits beyond 2020, citing the implementation of stricter national ambient air quality standards on 01 January 2015. The decision requires the facility to continue complying with minimum emission standards for existing plants.
• A postponement for compliance with the minimum emission standard for new plants regarding sulphur dioxide (SO2) is granted from 1 April 2020 to 31 March 2025, with a limit of 2600mg/Nm3. The facility must achieve a limit of 500mg/Nm3 by 01 April 2025, due to the station's significant contribution to the pollution load in the Highveld Priority Area and the lack of decommissioning plans.
• No decision was required for Nitrogen Oxides (NOx) because the application was found to be in compliance with legislated limits, meaning the requirement to comply with minimum emission standards for existing plants remains in effect.
• Eskom is required to implement an offset programme to reduce PM pollution in the ambient or receiving environment and must provide a definite offset implementation plan by 31 March 2016.
