The Nkangala District Municipality (NDM) issued a decision on 28 February 2014 regarding a request from Eskom Holding Limited to vary the Atmospheric Emission Licence (AEL) for the Kriel Power Station. Eskom sought variations based on "deteriorating coal quality, technical challenges faced by an aging facllity and the constrained electrical supply siluation in South Africa." The NDM rejected most of the requests concerning emission limits and monitoring timelines but granted an extension for an investigation into emissions during specific operating conditions.

• The Nkangala District Municipality (NDM) rejected Eskom's request to increase the maximum daily release rate for particulate matter to 390 mg/Nm³ (with 4 days a month at 550 mg/Nm³), maintaining the limit of 125 mg/Nm³ per unit under normal operating conditions. However, the NDM agreed to change the averaging period to a "calendar month basis, per unit, under normal operating conditions" for the period ending 31 March 2015.
• The NDM rejected a request to amend the duration of normal maintenance conditions from 48 hours to 37 days per year per stack. The municipality cited a lack of assessment regarding the "cumulative impact on the ambient environment" and determined that the dispersion modelling for elevated emission scenarios was not "fully representative of all potential meteorological conditions."
• Eskom's request to extend the deadline for installing continuous emission monitoring for PM, SO2, and NOx to 2016 was denied. The NDM noted that site observations on 10 January 2014 showed monitors were already installed on each unit and the South Stack, contradicting Eskom's representations. The NDM set a new deadline for the installation, commissioning, and verification of these systems during 2014, with reporting to commence by 1 January 2016.
• The NDM granted a request to extend the deadline for an investigation into emissions during start-up, maintenance, and shut-down conditions. The completion date for this investigation was amended to be "fifteen (15) months from dato of signature".
