CENTRE FOR ENVIRONMENTAL RIGHTS’ SUBMISSIONS IN RESPONSE TO THE JUDGE PRESIDENT’S DIRECTIVE DATED 17 APRIL 2023

The Centre for Environmental Rights (CER) submitted a legal argument to the High Court of South Africa stating that, as a registered and accredited law clinic that provides free legal services and does not handle client funds or property, it is legally entitled to litigate without a fidelity fund certificate or a trust account.

• The Centre for Environmental Rights (CER) is a non-profit public interest law organisation established in October 2009 that operates as a registered law clinic under section 34(8) of the Legal Practice Act 2014 (LPA) and rule 36 of the Legal Practice Council (LPC) Rules. It is formally recognised as a law clinic by the LPC's Gauteng and Western Cape Provincial Offices and maintains offices in Johannesburg and Cape Town.
• The CER asserts that it is not required to hold a fidelity fund certificate or operate a trust account because it does not conduct a 'trust account practice'. Specifically, the CER does not receive, hold, or take deposits on funds or property belonging to any person, nor does it provide legal services for civil claims for damages or specific restricted activities such as the administration of estates, company liquidations, or Road Accident Fund claims.
