PUBLIC PARTICIPATION IN RESPECT OF THE DRAFT INTEGRATED RESOURCE PLAN FOR ELECTRICITY 2018

The Centre for Environmental Rights (CER), representing several environmental and community organisations, sent a letter to the National Energy Regulator of South Africa (NERSA) on 19 November 2018. The letter demands that NERSA conduct a formal public participation process regarding the draft Integrated Resource Plan for Electricity 2018 (draft IRP 2018), arguing that NERSA is legally required to do so before concurring with the Minister of Energy.

• The Centre for Environmental Rights (CER) and its partners allege that the Department of Energy (DoE) failed to conduct adequate public participation for the draft IRP 2018, specifically citing the lack of public consultation meetings, failure to consult communities in the Waterberg, the Vaal, and the Mpumalanga Highveld, and the failure to release the modelling data used for the plan.
• CER asserts that NERSA is legally obligated to conduct its own public participation process before concurring with the Minister of Energy on the IRP. This is based on Regulation 4(1)(a) of the Electricity Regulations on New Generation Capacity, 2011, and section 10(1)(d) of the National Energy Regulator Act, 2004 (NERA), which requires decisions to be taken within a "procedurally fair process".
• The letter cites a Western Cape High Court case (Earthlife Africa Johannesburg and Another v Minister of Energy and Others) as legal precedent, which established that NERSA's decisions are administrative actions and must be subject to public participation to be procedurally fair.
