URGENT FOLLOW UP ON REQUEST FOR URGENT WITHDRAWAL OF THE PROVISION IN THE LIST OF ACTIVITIES REGARDING THE WEAKENING OF THE SULPHUR DIOXIDE NEW PLANT MINIMUM EMISSION STANDARDS FOR EXISTING PLANTS

A letter from the Centre for Environmental Rights (CER) to the Minister of Environmental Affairs demanding the withdrawal of an amendment to the List of Activities that weakened sulphur dioxide minimum emission standards for existing plants.

• The Centre for Environmental Rights (CER), representing several environmental groups including the Life After Coal/Impilo Ngaphandle Kwamalahle Campaign, the Khuthala Environmental Care Group, the Vukani Environmental Movement, and the Vaal Environmental Justice Alliance, is demanding the withdrawal of item 6 of the 31 October 2018 amendment to the List of Activities.
• The CER alleges that the amendment to the List of Activities was made without adhering to the legally required public participation process.
• Despite multiple extensions granted by the CER to the Department of Environmental Affairs—extending from December 2018 to January 2019—the Minister has not responded to the request for withdrawal.
• The CER has set a final deadline of 12 March 2019 for the Minister to withdraw the provision, after which they intend to initiate High Court review proceedings and seek a costs order.
