PROPOSED DETERMINATIONS FOR NEW GENERATION CAPACITY 2020

The Centre for Environmental Rights (CER) has written to Minister Gwede Mantashe seeking clarification on two draft determinations for new generation capacity. The CER questions whether the Minister has conducted or intends to conduct public participation as required for administrative actions affecting the public. Additionally, the CER seeks to determine if the proposed 1500 MW coal capacity allocation includes the 900 MW already appointed to 'preferred bidder' projects Thabametsi and Khanyisa, which would leave only 600 MW of new capacity available.

• The Minister of Mineral Resources and Energy signed two draft determinations on 18 February 2020: one for 2000MW of new generation capacity from sources including co-generation, biomass, landfill, and distributed generation; and another for 6800MW of renewable energy, 513 MW from storage, 3000 MW from gas, and 1500 MW from coal.
• The CER argues that issuing a determination under section 34 of the Electricity Regulation Act (ERA) is an administrative action that materially affects the public, and therefore asks the Minister to clarify what public consultation process has been or will be followed in accordance with the Promotion of Administrative Justice Act, 2000 (PAJA).
• There is ambiguity regarding whether the 1500 MW coal capacity allocated for 2023 to 2027 in the Integrated Resource Plan for Electricity 2019 – 2030 includes the approximately 863 MW (referred to as 900 MW in the CER's query) previously awarded to the 'preferred bidder' coal IPPs, Thabametsi and Khanyisa.
