UPDATE ON THE PREFERRED BIDDERS UNDER THE FIRST BID WINDOW OF THE COAL BASELOAD IPP PROCUREMENT PROGRAMME (THE PROPOSED THABAMETSI & KHANYISA COAL-FIRED POWER STATION) & STATUS OF ANY FUTURE BID WINDOWS

A letter from the Centre for Environmental Rights to the IPP Office of the Department of Energy requesting an update on the commercial and financial close deadlines for the Thabametsi and Khanyisa coal-fired power stations, noting that the deadlines of 2 and 3 November 2019 have expired.

• The deadlines for commercial and financial close for the Thabametsi and Khanyisa coal-fired power stations were 2 November 2019 and 3 November 2019, respectively, and have now expired.
• The Integrated Resource Plan (IRP) published on 18 October 2019 provides for 750 MW of coal-based electricity in 2023 and another 750 MW in 2027. The IRP includes 900 MW of "already-procured" coal IPPs on the condition that they comply with environmental legislation and that pending legal challenges are resolved in their favour.
• The Khanyisa project faces significant regulatory hurdles: its environmental authorisation (EA) likely expired on 31 October 2018 according to the Department of Environment, Forestry and Fisheries, and its water use licence (WUL) is under appeal at the Water Tribunal. Additionally, its EA is subject to judicial review at the Pretoria High Court.
• The Thabametsi project is also facing legal challenges, including a judicial review of its EA at the Pretoria High Court and an internal appeal regarding its atmospheric emission licence (AEL). Decisions on its electricity generation licence and WUL are still pending.
• Funding for the coal IPPs is identified as a risk, with Standard Bank, Nedbank, and First Rand having indicated they will not provide funding.
