ARCELORMITTAL SA VANDERBIJLPARK STEEL WORK (“AMSA”) MINIMUM EMISSION STANDARDS (MES) DECISION: REQUEST FOR INFORMATION AND REASONS

The Centre for Environmental Rights (CER), acting for the Vaal Environmental Justice Alliance and groundWork, has issued a formal request to the National Air Quality Officer and other authorities for the reasons and supporting documentation behind a decision to partly grant an application by ArcelorMittal South Africa (Vanderbijlpark) (AMSA). The decision relates to the suspension, alternative limits, or postponement of compliance with Minimum Emission Standards (MES) under the National Environmental Management: Air Quality Act, 2004.

• The Centre for Environmental Rights (CER) is requesting evidence that all registered Interested and Affected Parties (I&APs) were notified of the 23 March 2020 decision and their right to appeal within 14 days, as required by regulation 4(2) of the Environmental Impact Assessment Regulations, 2014.
• CER is specifically seeking the reasons why the National Air Quality Officer allowed AMSA to operate with emission limits for hydrogen sulphide (H2S) that are less stringent than the existing plant MES in sub-categories 3.2 of the List of Activities, noting that paragraph 11D prohibits such postponements or suspensions.
• The request includes a demand for a quarterly progress report on the implementation of AMSA's roadmap, commitment, and SO2 offset programme, which was reportedly due by 1 July 2020.
• CER asserts that the time period for lodging an appeal will only begin once full written reasons for the decision are received, citing the Promotion of Administrative Justice Act, 2000 (PAJA) and the Constitution of the Republic of South Africa, 1996.
