NOTICE OF APPEAL AGAINST THE DECISION TO GRANT APPLICATION FOR THE POSTPONEMENT OF COMPLIANCE TIME-FRAMES RELATING TO THE NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT 39 OF 2004 MINIMUM EMISSION STANDARDS (MES) UNDER REGULATION GOVERNMENT NOTICE 893, GOVEWRNMENT GAZETTE 37054, 2013 TO ARCELORMITTAL SA VANDERBIJLPARK STEEL WORKS (“AMSA”)

The Centre for Environmental Rights, acting on behalf of the Vaal Environmental Justice Alliance (VEJA) and groundWork, has filed a formal appeal to the Minister of Environment, Forestry and Fisheries against a decision to partially grant ArcelorMittal SA Vanderbijlpark Steel Works (AMSA) a postponement of compliance time-frames for Minimum Emission Standards (MES) under the National Environmental Management: Air Quality Act 39 of 2004.

• The Vaal Environmental Justice Alliance (VEJA) and groundWork are appealing a decision made by the National Air Quality Officer on 23 March 2020, which partially granted ArcelorMittal SA Vanderbijlpark Steel Works (AMSA) a postponement of compliance time-frames for Minimum Emission Standards (MES) under the National Environmental Management: Air Quality Act 39 of 2004.
• The appeal was formally submitted on 15 September 2020 and includes an Appeal questionnaire, an Appeal and Response Form, and a statement detailing the grounds of appeal with accompanying annexures.
• The appellants have requested condonation for the filing of the appeal, noting that they were not properly notified of the decision according to the legal requirements of regulation 4(1)(b) of the Appeal Regulations.
• The appellants argue that granting condonation is in the interests of justice due to the technical complexity of the matter, the public interest, and the expected impacts on health and the environment.
