• The Department of Environmental Affairs and Tourism defines 'New Plant' as any plant authorized to operate after the date the notice comes into effect, while 'Existing Plant' refers to any plant authorized to operate before that date.
• Compliance timeframes for emission standards are tiered: new plants must comply immediately upon the publication of the notice, existing plants must comply with existing plant standards within three years, and all existing plants must meet new plant standards within eight years of publication.
• Holders of an atmospheric emission license (AEL) for existing listed activities are required to develop and submit an emission reduction plan detailing how they will meet new plant standards; this plan must be part of the AEL renewal application under section 27 of the AQA.
• AEL holders may apply for a postponement of the compliance date at least one year before the deadline. This application must include an air pollution impact assessment by an independent party proving that emissions are not causing adverse environmental impacts or significantly contributing to exceedances of ambient air quality standards.
