The National Dust Control Regulations, 2012, are draft regulations issued by the South African Department of Environmental Affairs to prescribe general measures for the control of settleable particulate matter (dust) across all areas.

• The draft regulations establish acceptable dust fall rates measured at or beyond the boundary of the premises where dust originates. For residential areas, the dust fall rate (D) must be less than 600 mg/day (30-day average), and for non-residential areas, it must be between 600 and 1200 mg/day. In both cases, the permitted frequency of exceeding these rates is two times within a year, provided they are not in sequential months.
• Persons conducting activities that may exceed the dust fall standards must submit a dust monitoring report to the air quality officer within one year of the regulations' publication. This report must include sample locations with topographic map coordinates, area classifications, monitoring results, meteorological data, and other relevant influencing data.
• If the dust fall standard is exceeded, the responsible party must develop a dust management plan within three months of submitting the monitoring report. This plan must identify all possible dust sources in affected areas and detail the best practicable measures for dust control.
• Air quality officers have the authority to require a dust fallout monitoring programme if they suspect a contravention of the standards or if the activity requires a fugitive emission management plan. Furthermore, if a monitoring programme indicates non-compliance, the officer may require continuous ambient air quality monitoring for PM10.
• Contravening the regulations regarding baseline establishment, dust control measures, or monitoring programmes constitutes an offence. Conviction may result in a fine, imprisonment for up to five years, or both.
