Démocratie et responsabilité : Equilibrer le principe majoritaire et les droits de la minorité

The paper argues that accountability—defined as the obligation of those in power to justify their decisions—is the essential ingredient for successful constitutionalism. It proposes three tests for constitutionalism: the imposition of limits on government power, national legitimacy, and the protection of human rights. Using South Africa as an example, the author highlights a tension where liberation movements often transition into power-seeking elites, leading to the erosion of independent institutions, such as the dissolution of the 'Scorpions' anti-corruption unit and attempts to exert executive control over the judiciary. It concludes that a vigilant civil society and a culture of justification are necessary to prevent a 'winners and losers' scenario and to ensure that individual human rights supersede the need for group-based privileges.
