Economic Partnership Agreements and Intellectual Property Rights Protection Challenges for the Southern African Development Community (SADC) Region

This research paper examines the challenges facing the Southern African Development Community (SADC) regardingS regarding Intellectual Property Rights (IPRs) within the context of Economic Partnership Agreements (EPAs) with the European Union (EU). It highlights the tension between EU demands for higher IPR standards and the developmental needs of SADC countries, particularly concerning food security, public health, and innovation.

• By December 2007, the CARIFORUM was the only regional group to conclude a comprehensive EPA including IPR provisions, while other groups, including SADC, only initialled 'goods only' interim EPAs (IEPAs).
• While the SADC IEPA does not expressly include IPRs in its mandate for 'new generation' negotiations, the EU has emphasized that IPRs must be included in the EPAs.
• The EU's proposal for ACP countries to accede to the UPOV 1991 Act regarding plant variety protection could negatively impact regional food security due to the dynamics between large seed corporations and traditional farmers in the SADC region.
• EU proposals on IPR enforcement appear to transpose the EU Enforcement Directive, which contains 'TRIPS-plus' provisions that create new presumptions for right holders and may impact public health safeguards and judicial systems in SADC countries.
• SADC countries face significant challenges in utilizing IPRs to incentivize innovation because domestic innovation remains low and there is a lack of capacity in firms and research institutions to manage IPRs.
