Economic Partnership Agreements and Intellectual Property Rights Protection Challenges for the Southern African Development Community (SADC) Region

The paper examines the tension between EU efforts to include high intellectual property rights (IPR) standards in Economic Partnership Agreements (EPAs) and the developmental needs of SADC countries. While the SADC interim EPAs currently focus on goods, the author warns that 'TRIPS-plus' provisions—standards exceeding the WTO's TRIPS Agreement—could negatively impact food security, public health, and access to educational materials. The document argues that SADC nations must develop integrated policy frameworks and institutional capacity to manage IPRs and protect genetic resources and traditional knowledge before entering such negotiations.

• While the CARIFORUM concluded a comprehensive EPA with IPR provisions by December 2007, other regional groups, including the SADC, only initialled 'goods only' interim EPAs (IEPAs). The SADC IEPA does not expressly include IPRs in its mandate for further negotiations on 'new generation' issues, although the EU continues to emphasize that IPRs must be included.
• The inclusion of 'TRIPS-plus' provisions—standards higher than those in the WTO Trade Related Aspects of Intellectual Property Agreement—could create serious development-related consequences for SADC countries, who already face administrative and financial challenges regarding TRIPS enforcement.
• Specific risks associated with EU IPR proposals include restricted access to digital educational materials via the 1996 WIPO Internet Treaties and threats to regional food security if the UPOV 1991 Act is adopted, which could disrupt seed management between traditional farmers and large corporations.
• EU proposals on enforcement, largely based on the EU Enforcement Directive, are considered TRIPS-plus and may negatively affect public health safeguards and the capacity of SADC judicial and policing systems.
• To benefit from IPR systems, SADC countries need an integrated approach: building institutional capacity in firms and research centers, implementing national policies to increase R&D expenditure, and ensuring their interests regarding bio-piracy and traditional knowledge are codified internationally.
