Reform in the Contract State: Embedded Directions in Public Procurement Regulation in South Africa

This research paper examines the evolution of South Africa's public procurement regulation, analyzing the transition toward a 'contract state' and the ongoing efforts to reform a regulatory regime characterized by fragmentation and corruption.

• South Africa has adopted the international trend of an expanding 'contract state', where public procurement is increasingly vital for the state's operational and allocative functions. However, the resulting organizational form—centrally steered but decentralized—has been hindered by limited central steering capacity, leading to a regulatory regime that is incoherent, fragmented, and weak, which in turn contributes to corruption and state incapacity.
• In 2013, the Minister of Finance initiated a major reform of the contract state to strengthen and extend public procurement regulatory authority. This reform focuses on implementing a developmental, strategic, and centre-led procurement methodology, while attempting to replace rigid rules with more flexible, distributed disciplinary mechanisms that address gaps in political will and regulatory capacity.
