Submission to the Draft Public Procurement Bill

The Public Affairs Research Institute (PARI) submitted recommendations on the draft Public Procurement Bill [B – 2020], arguing that public procurement is critical to South Africa's economy but currently suffers from systemic corruption and operational failure.

• Public procurement represents a massive portion of the South African economy and state operations. In 2017, the South African Reserve Bank reported that the government spent R967-billion through public procurement, which was approximately 30 percent more than spending on employee compensation and represented 19.5 percent of GDP.
• South African public procurement is currently in a state of crisis characterized by corruption, non-compliance, and an inability to efficiently procure necessary goods, services, and infrastructure.
• PARI describes the South African state as a 'contract state' where capacity depends on managing private sector capabilities through contracts, a structure that has fostered clientelism and corruption. To address this, PARI proposes reforming regulatory forms to improve purchasing practices and black economic empowerment, while enhancing contract management and creating incentives for whistleblowing and the recovery of civil damages from fraud.
