Decree No. 2007-1455 of the Republic of Senegal defines the distribution of funds derived from fines and confiscations in economic litigation (competition and consumption). The funds are split between a common fund for Ministry of Commerce agents (33%), litigation participants (34%), department heads (8%), national directorate chief editors (8%), social works (2%), and an equipment/anti-fraud fund (15%). • Decree No. 2007-1455 establishes a new distribution system for funds collected from fines, penalties, transactions, and confiscations related to economic litigation, specifically in the areas of competition and consumption. This decree replaces Decree No. 80-921 of September 5, 1980.
• The revenue from economic litigation fines, penalties, transactions, and confiscations is distributed among several funds as follows: 33% to the common fund for all Ministry of Commerce agents, 34% to the fund for participants in economic litigation, 8% to the fund for department heads, 8% to the fund for chief editors of national directorates, 2% to the social works fund for commerce agents, and 15% to the equipment and fight against illicit commercial practices fund.
• The decree allows Ministry of Commerce civil servants serving outside the Ministry to be eligible for these payments, provided they are paid from the State budget and do not receive similar common fund compensations or advantages from their host administration.
