Négociations de l’OMC sur les subventions contribuant à la surcapacité et la surpêche : Quelques considérations clés en matière de développement durable

• The proposed WTO rules aim to be more comprehensive than the 2022 Agreement on Fisheries Subsidies. While the 2022 agreement focused on prohibiting subsidies for illegal fishing, overexploited stocks, and unregulated high-seas fishing, the new proposed rules seek to prevent subsidies from contributing to overfishing from the outset.
• The draft text represents a compromise between conflicting member interests, including tensions between current fishing nations and those developing fleets, industrial versus artisanal fishing, and the immediate needs of fishing communities versus long-term sustainability. Some members pushed for strict requirements that only proven effective management measures justify subsidies, while others argued that proving such effectiveness is difficult.
• Under the proposed rules, the riskiest types of subsidies would be prohibited unless credible fisheries management measures are in place. While developing countries would have a temporary exemption for subsidies to industrial fleets, this is time-limited. Permanent exemptions are more restricted, applying primarily to developing countries with a small share of global catches and to artisanal fishing.
• The disciplines would introduce unprecedented global transparency and monitoring of fisheries subsidies through a WTO committee. Furthermore, they would formally link multilateral and binding rules to the Sustainable Development Goals (SDGs) for the first time.
