Évaluation du cadre directif pour l’exploitation minière : Sénégal

This 2016 report by the International Institute for Sustainable Development (IISD) and the Intergovernmental Forum on Mining, Minerals, Metals and Sustainable Development (IGF) evaluates the legal and policy framework of the mining sector in Senegal. The assessment, conducted between April and August 2016, measures the country's readiness to implement the IGF Mining Policy Framework across six thematic areas: legal and policy environment, financial benefits, socio-economic benefits, environmental management, post-mining transition, and artisanal and small-scale mining (ASM). The report identifies a general 'medium' level of progress, noting that while legislative frameworks are relatively strong, significant challenges remain in field application, institutional monitoring, and the formalization of the ASM sector.

• Senegal's mining permit system is clearly defined by the 2003 Mining Code, requiring environmental and social impact assessments (ESIAs) and community consultations for most permits. However, civil society actors argue that these consultations are often insufficient, noting that documents are frequently provided only in French, which limits the participation of local communities.
• The government generates mining revenue through a combination of corporate taxes (30%), royalties (currently 3%), permit fees, and partial ownership of operations. While the transfer of tax provisions to the General Tax Code of 2012 improved transparency, generous tax exemptions under the 2003 Code have reduced potential government revenues and benefits for the population.
