Summary Comments to the Proposals for Amendment of the ICSID Arbitration Rules

The International Institute for Sustainable Development (IISD) provides commentary on the ICSID Secretariat's March 15, 2019, draft proposals for amending the ICSID Arbitration Rules, arguing that the proposed changes are insufficient for meaningful reform of investor-state dispute settlement (ISDS).

• The IISD asserts that the draft proposals issued by the ICSID Secretariat on March 15, 2019, do not sufficiently address the concerns of states and stakeholders regarding treaty-based investor-state arbitration and fail to drive significant reform of investor-state dispute settlement (ISDS).
• Because the ICSID Secretariat's own analysis suggests that certain priority reforms identified by states cannot be realized solely through changes to the Arbitration Rules, the IISD suggests that member states should consider amending the Convention on the Settlement of Investment Disputes Between States and Nationals of Other States (the ICSID Convention).
• The ICSID Secretariat's rule amendment process, which began in October 2016, aimed for a final proposal to be voted on by members in October 2019, with a deadline for public and state comments on the March 15, 2019 working paper (WP #2) set for June 10, 2019.
