Ensuring Development-supportive Accession of Least-developed Countries to the WTO: Learning from Nepal

This report analyzes Nepal's experience as the first least-developed country (LDC) to join the World Trade Organization (WTO) in April 2004, highlighting the challenges of a strenuous accession process and the inadequacy of post-membership technical assistance.

• Nepal's accession to the WTO was a difficult and lengthy process because it was required to follow the same complex procedures as non-LDCs, despite WTO commitments to streamline the process for LDCs. This was particularly evident during six rounds of bilateral negotiations where Members made stringent demands.
• Despite assurances that WTO members would exercise restraint, Nepal's trade commitments in goods and services are more stringent than those of many developing country Members and incumbent LDC Members, exceeding Nepal's economic development and capacity.
• While technical assistance was critical for documentation and capacity building during the accession phase, post-membership assistance has been insufficient, especially regarding supply-side constraints. Consequently, Nepal has not achieved its trade policy goals of narrowing the trade deficit and diversifying trade.
• Nepal negotiated better accession terms than Cambodia due to technical assistance and stakeholder participation, although many stakeholders felt excluded from the process.
• The report recommends that the WTO simplify accession for LDCs by removing the requirement for bilateral negotiations on market access, exempting them from commitments on tariffs and plurilateral agreements, and making the implementation of commitments conditional on receiving effective technical assistance.
