A call to stakeholders to engage in the public consultation

The International Institute for Sustainable Development (IISD) is calling for a broad range of stakeholders, particularly from developing and emerging economies, to participate in a public consultation on a draft Instrument on International Investment Contracts developed by UNIDROIT and the ICC.

• UNIDROIT and the International Chamber of Commerce (ICC) have released a draft Instrument on International Investment Contracts for public consultation from June 24 to September 15, 2026. This marks the first time the text has been shared with stakeholders outside of the project's Working Group.
• The UNIDROIT-ICC joint project began in 2023 with the goal of creating guidance to standardize and modernize international investment contracts using model clauses and principles, with the first working group meeting occurring on October 25, 2023.
• The IISD identifies three critical areas for scrutiny within the draft Instrument: the coherence of its dual objectives, whether sustainability provisions are operational or merely aspirational, and if investor protection standards maintain the right of states to regulate.
• The IISD argues that the final version of the Instrument should prioritize sustainability as a core operational objective and ensure an equitable allocation of rights and obligations, rather than adopting open-ended protections found in investment treaties.
