The Evolving Context and Dynamics of the WTO Joint Initiative on E-Commerce

This report provides a status update as of December 2022 on the Joint Statement Initiative (JSI) on Electronic Commerce, analyzing its position within national, regional, and multilateral e-commerce governance frameworks.

• The governance of e-commerce is evolving across three levels: national policy activity is increasing but risks fragmentation; regional Digital Economy Agreements are appearing as flexible tools for addressing innovations like artificial intelligence; and multilateral efforts post-COVID-19 are prioritizing the bridging of the digital divide to reinvigorate the WTO Work Programme on Electronic Commerce.
• Analysis of 2022 negotiation dynamics and the consolidated negotiating text from December 22, 2022, suggests that JSI participants are likely to pursue a less ambitious agreement by the 13th Ministerial Conference. This approach would prioritize e-commerce facilitation while deferring contentious issues related to market access.
